Work Permits – Tier System
Since 2008 the system of work permits has been simplified into what is known as the points based tier system. The system is divided into five categories:
Tier 1
This is the only category where an offer of employment is not required, in order to attract highly skilled individuals, entrepreneurs, investors, post graduate workers. Often permanent residence can be applied for, in this category.
The tier 1 (exceptional talent) category of the UK’s points-based system is now open for applications. The new category is for people who are internationally recognised as world-leading or potential world-leading talent in the fields of science and the arts.
Applications under tier 1 (exceptional talent) must be made from abroad. You cannot apply if you are already in the UK.
Tier 2
This category is for skilled workers with an offer of employment from a UK based company that sponsors that individual. For this reason the application is employer led, though a permanent residence can be applied for.
There are 4 categories of skilled workers under the points-based system. These are:
- General
- Minister of Religion
- Sports person
- Infra Company Transfer
Tier 3
This is mainly for low skilled or temporary workers with an offer of employment for example seasonal agricultural workers where the intention is to return back after the employment ends and dependants are not normally allowed entry.
Tier 4
This category is for overseas students that want to study in the UK.
Tier 5
This category is for temporary workers aged 18-30 from participating countries where entry is allowed up to two years. There are no residence rights after the period expires.

The Ayslum Process
Asylum is protection given by a country to someone who is fleeing persecution in their own country. It is given under the 1951 United Nations Convention Relating to the Status of Refugees. To be recognised as a refugee, you must have left your country and be unable to go back because you have a well-founded fear of persecution. In the UK this is extended under the European Convention on Human Rights, which prevents sending someone to a country where there is a real risk they will be exposed to torture, or inhuman or degrading treatment or punishment.
Since 2007, applications for asylum in the UK are aimed to be dealt with by the Home Office within six months of the application. In certain cases where applicants do not qualify for asylum, the Home office may grant temporary permission to stay in the UK.
